This firm represents AOL LLC and its subsidiary ICQ, Inc. (collectively “AOL”) with respect to
intellectual property matters. AOL is the owner of numerous domestic and foreign trademark
registrations, including Ukrainian ones, for the mark ICQ (Registration No. 25849) and the ICQ
Flower Logo (Registration No. 38817) (collectively, “ICQ Marks”). Our client uses the ICQ
Marks in interstate and international commerce in connection with, among other things, the
advertising, promotion, and sale of online services and communication software. Due to AOL’s
widespread use, advertising, and extensive marketing, the ICQ Marks have become famous, and
current and prospective customers recognize these marks as distinctive symbols of our client’s
goodwill.
It has come to our attention that you have registered and are using the domain name
with a commercial website in an unauthorized manner. See attached. AOL is
concerned that your use of its ICQ Marks and name in this manner is likely to confuse
consumers into falsely believing that AOL endorses or is affiliated with your site or services.
Moreover, your unauthorized commercial use of the ICQ Marks dilutes the distinctive qualities
of those famous marks and may subject you to liability under various statutes and laws.
AOL would prefer to resolve this matter in an amicable manner. To prevent any such consumer
confusion or dilution, we request that you contact us in writing to confirm that you have ceased
all unauthorized use of our client’s name and marks and will transfer to AOL the domain name
referenced above, as well as any other domain names you own or control that infringe upon our
client’s names or marks. 

We hope you appreciate our client’s interest in protecting its valuable intellectual property and
ensuring consumers are not misled or confused by third party use of its famous names and
marks. AOL would prefer an amicable and prompt resolution, and I request a reply by June 13,
